Bali Booking Services : Terms & Conditions

Terms and Conditions for all short-term-rentals-bookings

The Rental Contract sets the Terms and Conditions to be followed by the client who is paying for a rental booking through our services. Should the client violate any of these Terms and Conditions, Bali Booking Services reserves the right to terminate the Rental Contract.

1. The Rental Contract

1/ Bali Booking Services acts as the duly empowered booking agent of the property owners or the villa management companies that it represents. The contract is established between Bali Booking Services (further referred to as “Bali Booking Services” or as “we”) and the client.

2/ The client agrees to rent a holiday accommodation through the services of Bali Booking Services on the terms and conditions set out here after.

3/ The Rental Contract is not valid and effective until the client has confirmed a booking to Bali Booking Services in writing (email is considered a “writing”) and has cleared the payment of the deposit of 50%. Bali Booking Services will then confirm the payment and the booking in writing. The payment of the deposit will be considered as “cleared” once the amount due has arrived on the bank account of Bali Booking Services.

2. The Rental Rates

1/ All rates are quoted in USD and are inclusive of tax and service charges. Rates are subject to change. These changes can be imposed by the villa owner and can be applied without notification. Bali Booking Services will inform the client of these changes at the moment of a booking in case these changes have not been applied yet to the website. To facilitate the search on the website, a currency convertor has been installed in the website header, connected to an online currency provider and it gives a choice of several currency. However, all payments to Bali Booking Services have to be made in USD only.

2/ Rates do never include gratuities, telephone charges, wireless internet, spa treatments, meals, catering, petrol for cars and fees for drivers, or any other service, unless stated otherwise in the presentation of a villa.

3. Seasons and Minimum Stay

3/ Bali Booking Services always clearly indicates the specific dates of the seasons applied by the villa owner or the villa management company, and is not responsible for any changes made to these dates by the above. However, the client will be informed of such changes at the moment of his booking and before he confirms the booking.

In most cases, the villa owners and/or villa management companies impose a minimum number of days to be booked according to the applied season dates. However, in certain cases some flexibility is applied. We recommend the client to ask us for confirmation of these minimum stay numbers.

4. Payment Policy

1/ For bookings made more than 60 days prior to the arrival date, a deposit of 50% of the total rental amount must be received by Bali Booking Services within 5 working days after the confirmation of the booking at which time the client will have received the relevant pro forma invoice and payment instructions. If the deposit is not paid as required, the booking will not be finalized and this Rental Contract will be deemed void. The payment of the deposit will be considered as “cleared” once the amount due has arrived on the bank account of Bali Booking Services.

2/ For bookings made less than 60 days prior to the arrival date, the total rental amount payable will be settled in full at the moment of the booking.

3/ For bookings made less than 10 working days prior to the arrival date, the client will pay the total rental amount before entering the villa at arrival to the Bali Booking Services representative present at arrival, in cash, in USD, using impeccable recent USD bills (F series or newer only). Any other form of payment or payment in other currencies than USD, or payment in used and/or old USD bills will not be accepted, and access to the villa will be denied until this matter has been cleared.

4/ For all bookings made more than 60 days prior to arrival, the balance of 50% of the total rental amount must be received by Bali Booking Services before the end of the 60th day prior to arrival. If the balance is not paid as required, the booking will be considered as “cancelled” (see further). The payment of the balance will be considered as “cleared” once the amount due has arrived on the bank account of Bali Booking Services. If the payments of deposit and balance are due with a small interval in time we strongly advise the client to pay the total rental amount to avoid unnecessary bank transfer costs.

5/ All payments must be made only in United States Dollars. The USD rates displayed on the website are the applicable prices for your booking. Payments can only be made by bank transfer or credit card. Some conditions apply and full details will be given at the time of booking.

6/ Security deposits are required for some villas. If required, the security deposit must be paid in full to Bali Booking Services at the payment of the balance or full rental amount. The security deposit will be refunded in full ten working days after departure, unless damages have been caused and repairs need to be performed, in which case, the security deposit will be refunded, less the cost of damages incurred. The client will receive copies of all invoices paid for these repairs.

7/ For all payments to Bali Booking Services, the bank costs that come with these payments will be paid by the client. If payments are made in other currencies at the start, we strongly advise the client to check if the total amount, after currency conversion, will still be the amount due in USD at arrival on our bank account.

5. Identity Verification

1/ The client will provide a list with all identities, gender and age of all members of the holiday party to Bali Booking Services, at the moment of the confirmation of the booking. Some villas and/or villa management companies may require the holiday party to provide their KTP cards and/or passports to the Manager on duty on arrival at the villa for registration with the local authorities. If a client refuses to provide copies of passports or KTP cards as required, this is deemed a cancellation of the booking.

5. Booking Cancellation

1/ Are considered as “cancellation of a booking” :

  • cancellation of one or more days of a booking

  • amendments to a booking that include a change of dates

  • refusal to provide passports as in clause 5.1

  • attempt of the client to hold an event at the villa without prior authorization (see further)

  • direct cancellation by the client in case of non payment of balance or deposit at the above stated moments in the booking process, or full amount at arrival

  • the client arrives at the villa with a party that exceeds the maximum occupancy of the villa and/or is not according to the list of the party members given at the time of the booking. Please note that each villa has the maximum occupancy clearly stated on our website. Exceptions and/or extra beds can sometimes be provided, but this has to be organized at the time of the booking.

2/ A booking will be refunded in full, less 500 USD and 20% of the total booking amount if the cancellation happens 61 days or more prior to the arrival date. Please note that if multiple villas are booked, a cancellation fee is payable in relation to each individual villa. Notice of cancellation must be received by Bali Booking Services in writing via email.

3/ Bookings cancelled less than 61 days prior to arrival, are subject to a complete forfeiture of moneys already paid to Bali Booking Services. Notice of cancellation must be received by Bali Booking Services in writing via email.

6. Changes Made To Bookings

1/ Changes to bookings that are made within 61 days or more prior to arrival, can only be made with the approval of both Bali Booking Services and the owner and/or villa management company. An administration fee of 200 USD is payable by the client for each change made to the booking after the booking has been confirmed. The change to the booking will depend upon the payment of the administration fee and the approval of this change. Requests for changes to bookings cannot always be accommodated, and an increase in the booking fee may be applicable, depending on the changes requested. Certain changes may be considered cancellations, as stated in 5.1

7. Events Organized By The Client

1/ Villas have strict rules governing their usage for events and parties. Normal bookings are for vacation purposes only and the client and/or his guests may not hold an event or function at the villa without obtaining prior written approval from Bali Booking Services. If an event is permitted at the villa, an event fee, in addition to the local community or ‘Banjar’ fee, can be applied. We strongly advise the client to inform with us before the booking.

2/ Any breach of the villa’s requirements for events may result in cancellation of the booking and/or termination of the Rental Contract.

8. Damage and Loss

1/ The client is responsible for leaving the villa in good order and in a clean condition. The client engages himself with this contract to pay for any loss and/or damage to the villa during the client’s occupation of the villa. Bali Booking Services and/or the owner and/or the villa management company reserve the right to repossess the premises if the client or a guest of the client have caused damage to the premises. In case a security deposit has been paid at the moment of the booking, this deposit will be used to pay for the loss and/or damages. In case no security has been asked beforehand, the client engages himself with this contract to pay an estimated repair amount forwarded by Bali Booking Services. In case the client refuses to take his responsibility, the local authorities will be notified at once and the client may have to postpone his departure from the island until this matter has been cleared.

9. Force Majeure

1/ If the client considers that he has cause for complaint concerning the villa, the matter should be taken up promptly with the Villa Manager, who will in turn notify Bali Booking Services. Bali Booking Services will not entertain complaints made after the client has left the villa, when it is unable to properly investigate the complaint.

2/ Bali Booking Services shall not be liable to the client and his party for any failure to perform any obligations under this Rental Contract due to “force majeure”, including acts of civil or military disturbances, power failures, fires, floods, epidemics, wars, riots and acts of terrorism. In the event of such an occurrence, Bali Booking Services shall give prompt written notice thereof to the client and any delay in the completion of any of the contract obligations will be extended with the same amount of time as the delay itself.

10. Liability

1/ Bali Booking Services makes every effort possible to ensure that its web descriptions are accurate and that the villa meets its required standards. However, Bali Booking Services does not accept responsibility for any alterations made to the villa or its amenities, facilities and services, which are beyond its control. Bali Booking Services and the villa owner or villa management company, will not accept any responsibility or liability for any injury, sickness, loss, damage, additional expense or inconvenience, directly or indirectly caused by or arising out of the use or condition of the villa, its plumbing, gas, electrical or otherwise, and exceptional weather conditions, that is suffered or alleged to be suffered by the client and his guests. No responsibility is accepted by Bali Booking Services and/or the villa owner and/or the villa management company, for the personal belongings, vehicles and contents of vehicles of the client and his guests.

2/ Bali Booking Services reserves the right to immediately terminate this Rental Contract in the event the client breaches one or more of the Terms and/or Conditions herein. This Contract is governed by the laws and regulations of the Republic of Indonesia.

11. Some Recommendations

1/ It is the client’s sole responsibility to ensure that he and his party comply with the Laws and Regulations of the Republic of Indonesia, and Bali Booking Services takes no responsibility for any acts or omissions by the client and/or his guests that are illegal or breach any Laws or Regulations of the Republic of Indonesia.

2/ Bali Booking Services strongly recommends that the client and his party and all guests obtain appropriate travel and medical insurance.

3/ It is the client’s and their guests’ sole responsibility to ensure that every member of the booking party holds appropriate travel documentation to comply with the Laws and Regulations of the Republic of Indonesia for entry and visitation to the Republic. Bali Booking Services will not provide refunds where the client or any of his guests do not hold appropriate travel documentation, if they miss their flights or travel connections, or if flights or travel connections are delayed or cancelled.

4/ International payments can take some time. We strongly recommend our clients to arrange any payment a couple of days in advance in order to avoid slow international transfers or any other delays in payment caused by the banks in sending or receiving the funds send. We strongly recommend our clients to pay via the online payment system that is provided during the booking process.

5/ The client hereby accepts that the reply email that is send to Bali Booking Services as an answer to the email that contains the above Terms & Conditions, is considered as “the read and approved” status of these Terms & Conditions” by the client. No signature is required.
